3- and 10-Year Bars
Bars to reentry triggered by accruing unlawful presence and then leaving the U.S.
Departing the U.S. after 180+ days of unlawful presence triggers a 3-year bar; departing after 1+ year triggers a 10-year bar. The bars are activated by departure, which is why I-601A allows certain immediate relatives to obtain a provisional waiver before leaving.
