Filing: step by step

Step 1: Determine your eligibility category

Your eligibility category (listed on the I-765 form under Part 2) determines your filing fee, supporting evidence, and processing path. Most green card applicants use category (c)(9) — adjustment applicant with pending I-485.

The best practice is to file Form I-765 and Form I-131 (advance parole) at the same time as your I-485. Benefits:

  • No separate filing fees
  • USCIS issues a combo EAD/AP card — one card for both work authorization and travel

Step 3: Submit biometrics

The combo EAD/AP card

When you file I-765 and I-131 together with your I-485, USCIS issues a single combo card that serves as both your Employment Authorization Document and your Advance Parole travel document.

The combo card:

  • Lets you work for any employer in the U.S.
  • Lets you travel internationally and return without abandoning your I-485
  • Is valid for 2 years (standard validity period in 2026)
  • Replaces the need for two separate applications and two separate cards

This is the default approach in 2026 — USCIS no longer issues separate EAD and AP cards when both are requested concurrently with I-485.

Renewing your EAD

If your I-485 is still pending when your EAD expires, you can file a renewal I-765. Key points:

Conservative approach: Maintain H-1B status until your I-485 is clearly going to be approved (interview completed, no issues flagged). Use the EAD only if you need to change employers or if your H-1B is expiring.

Common issues

Lost or stolen EAD

File a replacement I-765 with a police report (if stolen) or a written explanation. The fee is the same as a new application unless your I-485 is pending.

Name change

EAD shows wrong information
